The following Terms and Conditions govern and apply to your use of or reliance upon this website maintained by StigmaZero (the “Website”).

Your access or use of the website indicates that you have read, understand and agree to be bound by these Terms and Conditions and any other applicable laws, statutes and/or regulations. We may change these Terms and Conditions at any time without notice, effective upon its posting to the Website. Your continued use of the Website will be considered your acceptance to the revised Terms and Conditions.

  • DEFINITIONS
    • Activity” means any of the activities of StigmaZero, specifically online training programs, services and solutions, as elaborated and offered through the Site from time to time;
    • Activity Fee” means the full annual amount charged by StigmaZero to Participant for participation in the Activity, as more fully elaborated on StigmaZero’s Site from time to time; and
    • Age of Majority” means the legally defined age at which a person is considered an adult, with all the attendant rights and responsibilities of adulthood. The age of majority is defined by law, which may vary by state, province and country;

  • USER TERMS AND CONDITIONS

In this Contract, the following terms have the following meanings respectively:

2.1 StigmaZero, and any of its employees, directors, officers, agents, representatives, or assigns reserves the right in its sole discretion to refuse entry, or to remove the Participant named above, from participation in any activity organized by StigmaZero for any reason whatsoever. Any such refusal of entry or removal by StigmaZero shall be in its sole discretion and without refund.

2.2 StigmaZero and any of its employees, directors, officers, agents, representatives, or assigns are not responsible or liable in any way for the health, safety, or wellbeing of the Participant during the Activity or thereafter.

2.3 Participant shall comply with and observe all rules and regulations StigmaZero and the terms and conditions of this Agreement at all times.

The Contract may be executed in counterparts.

3.1 The Participant hereby waives, releases, indemnifies and discharges any and all claims for damages or personal injury, death, divorce, loss of income, loss of job, sanctions, mental illness, irresponsible behaviour or property damage which may have or which may hereafter accrue as a result of participation in the Activity. StigmaZero, its officers, directors, members and managers, and all other member of staff whether contracted or employed, are discharged in advance from and against any and all liability arising out of or connected to in any way with any participation in the Activity.

3.2 The Participant hereby waives, releases, indemnifies and discharges any and all claims for damages or loss to personal property. StigmaZero holds no responsibility whatsoever for replacing lost, misplaced, stolen and/or damaged property. The Participant assumes full responsibility and risk for any and all such losses or theft thereof.

3.3 The Participant understands that the Activity is voluntary. The Participant agrees to assume any and all risks of injury including physical and/or mental or death and to release and hold harmless StigmaZero, its officers, directors, members and managers, and all other members of the staff whether contracted or employed. The Participant understands and agrees that this waiver, release and discharge of risks is to be binding on the Participant, their heirs and assigns.

4.1 The Participant shall not use the copyright, design right and all other intellectual property rights including but not limited to materials, logos, designs, documents and/or items of StigmaZero without the prior written consent of StigmaZero.

4.2 The Participant agrees that the license for the Activity granted to them is for their singular use and all information and documentation provided to the Participant remain the exclusive property of StigmaZero. The dissemination, reproduction, sharing, transferring and/or copying of the Activity for commercial purposes is prohibited, without the prior written consent of StigmaZero.

4.3 The Participant is of the age of majority and has the power and authority to enter into and perform the obligations under the Terms and Conditions and agree not to distribute information they receive from the Site to those under the age of majority or those who would be violating the law by accessing such material in their jurisdiction.

4.4 By accessing the Site, the Participant expressly acknowledges and consents to viewing adult oriented material and releases and discharges in advance StigmaZero, its officers, directors, members and managers, and all other members of the staff whether contracted or employed harmless from any loss, claim, or demand, including reasonable attorney fees, as a result of viewing the Contents included in the Site.

4.5 StigmaZero may affect changes to the Site, Content, Terms and Conditions and/or Products described on the Site at any time.

4.6 StigmaZero attempts to make every effort to ensure that the Content on the Site is complete and current. However, StigmaZero does not warrant the quality, accuracy or completeness of Content on our Site. Such information is provided “as is” without warranty or condition of any kind. This Site may include inaccuracies, typographical errors, errors or omissions. Such errors, inaccuracies, typographical errors or omissions may relate to price or to product description or availability. In no event shall StigmaZero be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use or performance of Content available on this Site.

5.1 The Participant’s personal identifiable information may not be sold, traded and/or otherwise transferred to third parties except in accordance with StigmaZero’s business obligations. Notwithstanding the foregoing, StigmaZero reserves the right to release the Participant’s personal identifiable information to comply with the law and enforce policies in view of protecting its rights, and for safety matters.

5.2 The Participant hereby explicitly and unambiguously consents to the collection, use, and transfer, in electronic or other form, of his or her personal data as described in this document by and among, as applicable, the Company and its Subsidiaries or Affiliates for the exclusive purposes of implementing, administering and managing the Participant’s participation in the Activities. The Participant understands that StigmaZero and its Subsidiaries or Affiliates may hold certain personal information about the Participant, including, but not limited to, name, home address, date of birth, salary, job title, medical conditions, diagnoses and notes, electronic mail address, for the purpose of managing and administering the Activities and producing any research or reports related thereto (“Data”). The Participant further understands that the Data may be transferred to any third parties assisting StigmaZero in the implementation, administration, and management of the Activities (“Data Recipients”). The Participant understands that these Data Recipients may be located in his or her country of residence or elsewhere, such as Canada and the United States, and that the Data Recipient’s country may have different data privacy laws and protections than the Participant’s country. The Participant understands that refusing or withdrawing his or her consent may affect his or her ability to participate in the Activities.

5.3 StigmaZero shall communicate with the Participant to provide documents through various forms of electronic communications, including email through the public internet. These electronic communications may contain information that is confidential or privileged, unless you instruct us not to send such information electronically. There is a risk that and such electronic communications may be intercepted or interfered with by third parties or may contain computer viruses. StigmaZero, its officers, directors, members and managers, and all other members of the staff whether contracted or employed from and against any and all liability arising out of or connected to in any way with any event occurring as a result of electronic communications.

6.1 In the event that any provision or part of the Contract shall be deemed void or invalid by a Court of competent jurisdiction, the remaining provisions, or parts of it shall be and remain in full force and effect.

6.2 The headings utilized in the Contract are for convenience only and are not to be construed in any way as additions or limitations of the covenants and agreements contain in the Contract.

6.4 The Contract constitutes the entire agreement between the parties and any and all previous contracts, written or oral, express or implied between the parties or on their behalf relating to the Activity are terminated and cancelled and each of the parties releases and forever discharges the other of and from all manner of actions, causes of action, claim or demands whatsoever under or in respect of any previous contract.

6.5 The Contract will be governed by and construed in accordance with the laws of the Province of Quebec with regard to any conflict of laws or rules or principles which might refer to the governance or construction of the contract to the laws or another jurisdiction. Any action by or against either party arising out of the Contract shall only be brought before and settled by the competent Court of the Province of Quebec, Canada and to that effect the parties herein elect domicile in the city and district of Montreal, Province of Quebec.
